Constable Harmon did not have a partner at the time of the occurrence.

When a call for service results in a police constable being dispatched to a location, the officer must remain alert and prepared to deal with any situation. A disorderly person might turn out to be an armed gang member wanted in another jurisdiction and a robbery could be a tween having their cell phone taken from them by their parents. In this instance, a police officer was informed by the call taker that:

NEIGHB AT [residence of subject] WAS TAKTNG PICTURES OF HER CHILDREN, SAYS WE HAVE BEEN OUT REGARDING TRESPASSING

After speaking to the complainant at her home, Constable Harmon drove his marked police cruiser down the street to park in front of the subject's residence. He exited his vehicle and proceeded on to the property and up the porch steps to knock at the front door. A few moments later, the subject opened the door and exited his home to speak with the officer on his porch. He was informed that:

You were standing on your front porch this morning yelling at kids while taking pictures of them and their mothers as they walked to school. Constable Luke Harmon, September 29, 2010

The subject responded, "I haven't been outside today."

That's a problematic response. Two people, two stories, two possible violations of the law. What will a member of the professional police service do?

Fair warning given
Mr. Harmon's employer has been notified that he is prohibited from entering property owned or controlled by his victims. The Windsor Police Service, through a Deputy Chief's office, is now aware that Mr. Harmon is considered an immediate, armed and dangerous threat. He will always be viewed as such - the character of the man precludes anything else.

Formal notice

Written notice hand delivered to the individual's negligent institution, as defined by §22.1(b) of the Canadian Criminal Code1. The portion constituting a formal notice under the Tresspass to Property Act lawfully prohibits entry onto property owned, controlled, or occupied by the authors. A second portion, dealing with the common law, prohibits entry or communication for any purpose. It makes clear that the presumption at §3.(2) of the Act is invalid.
