Chief Al Fredrick believes that the Ontario Police Services Act allows him and, generally, law-enforcement, to come to an independent judgement outside of the criminal courts. Written notice hand delivered to the individual's negligent institution, as defined by §22.1(b) of the Canadian Criminal Code1. The portion constituting a formal notice under the Tresspass to Property Act lawfully prohibits entry onto property owned, controlled, or occupied by the authors. A second portion, dealing with the common law, prohibits entry or communication for any purpose. It makes clear that the presumption at §3.(2) of the Act is invalid.
